Parties to the Agreement

  • Publisher: Häme University of Applied Sciences (later. "HAMK")
  • Author(s) of the publication (later. "Author")

Purpose of the Agreement

With this agreement, the Author gives HAMK the right to publish and make publicly available a publication in one of HAMK's publication series. These are:

  • HAMK Pilkku (ISSN: 3087-5757)
  • HAMK publications (ISSN: 1795-4231)
  • HAMK's e-publications (ISSN: 1795-424X).

Publications at HAMK are produced mainly in electronic format. Publications can be printed only if there is a weighty reason to do so. In these cases, layout and printing costs are separately agreed upon. Apart from such separately agreed costs, publishing in HAMK Pilkku is free of charge for HAMK staff and students.

This agreement is created when the manuscript is submitted to the editing process. If the manuscript has more than one Author, being published requires that all authors agree to the terms and conditions of this agreement. The contact person or the Author acting as the contact person must ensure that the contents of this agreement are made known to all co-authors and that all authors understand these terms. In addition, the Author acting as the contact person confirms that they give these permissions both on behalf of themselves and all their possible co-authors.

Copyright

The Authors retain all intellectual property rights, including copyrights to the publication. However, Häme University of Applied Sciences may use the publication that is subject to this agreement for education and research purposes, also in cases that can be considered as commercial use.

The publication is published under the Creative Commons CC BY-NC-SA copyright license, which means that it can be freely read, downloaded and distributed under the following conditions:

  • The original publication context and author information must be credited
  • The publication or any variations based on it may not be used for commercial purposes
  • Any variations based on the publication must be published under the same license.

Obligations of the Author

The Author is responsible for the content of the publication and the rights to use its content. The Author declares that the publication has been written in accordance with good scientific practice and that they have the necessary rights to enter into this agreement. This includes, among other things, the rights to use all images and tables in the publication, as well as other possible supplementary material. The Author also confirms that they have had the appropriate right to use the data or permission to collect it.

The Author assures that authorship has been agreed upon between all those involved in the publication, in accordance with discipline-specific practices. Unless otherwise stated in the publication, the authors mentioned in the list of authors share the responsibility for the entire publication jointly and severally.

The Author is responsible for ensuring that they have not transferred the publishing rights under this agreement to another publisher.

The Author is obliged to notify HAMK without delay if these declarations prove to be incorrect. The responsibility for handling and resolving any possible third-party claims lies with the Author(s).

HAMK's obligations

HAMK provides access to the publication. HAMK takes care of making the publication available online and publishes a notice related to the use of copyrighted material in connection with the service. HAMK also stores the publication on their archive server.

Resolving Disputes

Any disagreements arising from the interpretation of this agreement shall primarily be resolved through negotiations. If negotiations do not lead to a resolution, the dispute shall be submitted to the Kanta-Häme District Court.
